These Terms & Conditions (“Terms”) govern your use of the facilities, services and website of Atlantis Gym & Spa, which is operated by ESPRIT FITNESS LIMITED (trading as “Atlantis Gym & Spa”, referred to as “Atlantis”, “the Club”, “we”, “us” or “our”). Please read these Terms carefully. By becoming a member, using our facilities, booking a class or treatment, or using our website, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our facilities or services.

2. Definitions
In these Terms:
- “Member” means any person who has entered into a membership agreement with Atlantis.
- “Membership” means the membership package selected by you, as described on our website or in your membership agreement.
- “Facilities” means the gym, swimming pool, sauna, steam room, jacuzzi, studios, treatment rooms and any other amenities provided by Atlantis.
- “Services” means classes, beauty treatments, Reiki, sports therapy, and any other services we provide.
- “Minimum Term” means the minimum committed period of your Membership (for example 6 months, 12 months, or an annual paid-in-advance term).
- “Website” means https://www.atlantisgym.co.uk and any associated pages.
3. Membership
3.1 Eligibility and age requirements
- Standard adult Memberships are available to persons aged 18 and over.
- Student Memberships are available to eligible persons under 21 on production of valid proof of student status and age.
- Persons under 18 may only use the Facilities in accordance with our supervision, family swim and age policies (see Section 9), and a parent or legal guardian must sign and accept responsibility on their behalf.
- We may require proof of identity, age, address or eligibility before accepting an application.
3.2 Applying for Membership
Your Membership begins when we accept your completed application and you have paid any applicable joining/administration fee and your first payment. We reserve the right to decline any application at our discretion.
3.3 Membership is personal to you
Membership is personal and non-transferable. You must not allow any other person to use your Membership, access card, fob or login to enter the Facilities. Misuse may result in suspension or termination of your Membership.
4. Membership types, fees and payment
4.1 Membership options
We offer a range of Memberships, which may include single, joint, student, off-peak, weekend, gym-only, spa-only, annual and family options. The Memberships available, what they include, and their prices are set out on our website and may be updated from time to time. “Gym or Spa Only” Memberships include access to either the gym or the spa facilities, not both.
4.2 Administration fee
A one-off, non-refundable administration fee is payable on joining, as stated on our website at the time of joining.
4.3 Fees and payment method
- Monthly Memberships are payable in advance by Direct Debit (or other method agreed with us) on the payment date set out in your membership agreement.
- Annual Memberships are payable in full in advance.
- You are responsible for ensuring sufficient funds are available. If a payment fails or is returned, we may charge a reasonable administration fee to cover our costs and may suspend access until the amount is paid.
- All prices are in pounds sterling (£) and include VAT where applicable.
4.4 Changes to fees
We may change Membership fees. We will give you at least one month’s written notice (by email or post) of any change to your recurring fee before it takes effect. If you do not wish to continue at the new fee, you may cancel in accordance with Section 6.
5. Minimum term and renewal
- Where your Membership has a Minimum Term, you commit to remain a Member and to pay the agreed fees for that full period.
- At the end of the Minimum Term, monthly Memberships will normally continue on a rolling monthly basis until cancelled in accordance with Section 6, unless stated otherwise in your membership agreement.
- Annual paid-in-advance Memberships expire at the end of the paid term and will not auto-renew unless you choose to renew.
6. Cancellation, cooling-off and suspension
6.1 14-day cooling-off period
If you joined at a distance (for example online or by phone) or away from our premises, you have the right to cancel within 14 days of your Membership starting under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, contact us at general@atlantisgym.co.uk or 01621 816955. If you have used the Facilities during this period, we may make a reasonable deduction for use.
6.2 Cancelling after the cooling-off period
- During the Minimum Term: you remain liable for the fees for the remainder of the Minimum Term unless you are entitled to cancel under Section 6.3.
- After the Minimum Term (rolling monthly Memberships): you may cancel by giving us at least one calendar month’s written notice. Cancelling a Direct Debit alone does not constitute notice of cancellation; you must also notify us directly.
6.3 Cancelling for a valid reason
You may be entitled to cancel during the Minimum Term without further charge in certain circumstances, for example:
- a long-term illness or injury, certified in writing by a doctor, that prevents you from using the Facilities;
- permanent relocation that makes attending the Club impractical (proof may be required);
- a significant and lasting reduction in the Facilities or Services we provide. We will consider such requests reasonably and may require supporting evidence.
6.4 Freezing/suspending your Membership
We may, at our discretion, allow you to suspend your Membership for a limited period (for example for illness, injury, pregnancy or travel). Any freeze must be agreed in advance and may be subject to conditions or a reduced holding fee.
6.5 Refunds
Except where required by law (including the cooling-off right above and your rights under the Consumer Rights Act 2015), Membership fees and the administration fee are non-refundable.
7. Use of the facilities
7.1 Opening hours
Our opening hours, family swim times and class timetable are displayed at the Club and on our website. Hours may vary on bank holidays and during maintenance, refurbishment or events. We will make reasonable efforts to publicise temporary changes in advance.
7.2 Availability
Access to specific Facilities depends on your Membership type. Certain Facilities may be temporarily unavailable. For example, the pool may be unavailable during aqua classes (the spa generally remains open). We may close part or all of the Facilities for maintenance, repairs, cleaning, staff training, private hire or events. Please vacate the Facilities at least 15 minutes before closing.
7.3 Member conduct
You must:
- behave in a respectful, safe and considerate manner towards other members, guests and staff;
- follow all rules, signage and reasonable instructions given by our staff;
- wear appropriate clothing and footwear for the activity and Facility you are using;
- use equipment correctly and only for its intended purpose, and report any faults to staff;
- not bring alcohol or illegal substances onto the premises, or attend while under their influence;
- not engage in abusive, threatening, discriminatory or anti-social behaviour.
We may refuse entry, require you to leave, suspend or terminate your Membership if you breach these Terms or behave in a way that is unsafe or unacceptable. No refund will be due where termination results from your serious or repeated breach.
8. Health, fitness and your responsibility
8.1 Fitness to exercise
You are responsible for ensuring that you are in good health and physically able to use the Facilities and participate in any activity or treatment. If you have any doubt about your fitness, or any medical condition, injury, pregnancy or are taking medication that may be affected by exercise, you should consult your doctor before using the Facilities.
8.2 Health declaration
We may ask you to complete a health questionnaire (PAR-Q) before using certain Facilities or Services. You must answer honestly and tell us about any change in your health that may affect your safe use of the Facilities.
8.3 Use at your own risk
You use the Facilities and equipment, and undertake activities, at your own risk, except where injury or loss is caused by our negligence or breach of legal duty. Nothing in these Terms limits or excludes our liability where it cannot lawfully be limited or excluded (see Section 13).
9. Pool, spa, classes, treatments and children
9.1 Pool, sauna, steam room and jacuzzi
You must follow all posted safety rules and the instructions of staff and lifeguards. Showering before entering the pool, appropriate swimwear, and observing capacity and time limits may be required. Use of the sauna, steam room and jacuzzi may not be suitable for people with certain medical conditions or for those who are pregnant; please seek medical advice if unsure.
9.2 Classes and bookings
Classes may need to be booked in advance and are subject to availability and minimum/maximum numbers. Please arrive on time; late arrivals may be refused entry for safety reasons. We may change, substitute or cancel classes and instructors. If you cannot attend a booked class, please cancel in good time so the space can be offered to others; repeated non-attendance may result in booking restrictions.
9.3 Beauty treatments and Reiki/therapy
Treatments and therapy sessions are subject to availability and may require a consultation, patch test or health declaration beforehand. Please give reasonable notice if you need to cancel or rearrange an appointment; a cancellation charge may apply for missed or late-cancelled appointments. Treatments and therapies are intended to support wellbeing and are not a substitute for medical advice or treatment.
9.4 Children and supervision
Children and young people may only use the Facilities at permitted times (such as family swim sessions) and must be supervised by a responsible adult in accordance with our supervision policy. Parents and guardians are responsible for the behaviour and safety of children in their care at all times.
9.5 Guests and visitors
Guests may be permitted at our discretion and may be subject to a guest fee and to these Terms. Members are responsible for the conduct of their guests.
10. Personal property and lockers
- Lockers, where provided, are for use during your visit only and must be cleared before you leave. Any items left in lockers may be removed.
- Please do not bring valuables onto the premises. We are not responsible for loss of or damage to your personal property, except where caused by our negligence or breach of legal duty.
11. CCTV and photography
We operate CCTV in and around the Facilities for the safety and security of members, guests and staff, and for the prevention and detection of crime. CCTV footage is processed in accordance with our Privacy Policy. Members and guests must not photograph or film others in the Facilities (particularly in changing areas, the pool or spa) without consent.
12. Website use
You may use our website for lawful purposes only. You must not misuse the website, attempt to gain unauthorised access, or introduce malicious code. The content of our website is provided for general information and is owned by or licensed to us; you may not reproduce it without our permission. We may update or withdraw website content at any time.
13. Our liability
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
- We provide our Services with reasonable care and skill in accordance with the Consumer Rights Act 2015. Your statutory rights as a consumer are not affected by these Terms.
- Subject to the above, we are not liable for loss or damage that is not foreseeable, or that arises from your failure to follow our rules, signage or staff instructions, or your own misuse of the Facilities.
- We are not responsible for any failure or delay in performing our obligations caused by events outside our reasonable control (for example utility failures, severe weather, or other emergencies).
14. Data protection
We process your personal information (including health information you provide) in accordance with the UK GDPR and the Data Protection Act 2018. Details of how we collect, use and protect your data, and your rights, are set out in our Privacy Policy (https://www.atlantisgym.co.uk/privacy-policy) and Cookie Policy (https://www.atlantisgym.co.uk/cookie-policy).
15. Complaints
We aim to provide a friendly, high-quality experience. If something is not right, please speak to a member of staff or email general@atlantisgym.co.uk so we can put it right. We will acknowledge and respond to complaints within a reasonable time.
16. Changes to these Terms
We may update these Terms from time to time to reflect changes to our Facilities, Services, or legal and regulatory requirements. The current version will always be available on our website, with the “Last updated” date shown above. Material changes affecting your Membership will be notified to you by email or post and/or by prominent notice at the Club.
17. General
- If any part of these Terms is found to be unenforceable, the remaining provisions will continue to apply.
- A failure by us to enforce any provision is not a waiver of our right to do so later.
- These Terms are between you and us; no other person has any rights to enforce them.
18. Governing law and jurisdiction
These Terms are governed by the law of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
